Federal judge's order bars some of the worst sections of SB 1070 from going into effect.
Community
leaders expressed relief that Judge Bolton agreed with plaintiffs and placed a preliminary injunction on key pieces of
1070 barring them from going into effect on July 29th. The "Papers Please"
component was enjoined meaning officers won't be able to stop someone merely on
suspicion that they lack proof of citizenship. Police won't be able to detain
people merely because they are not carrying documents to prove they are here
legally. The "Reasonable suspicion" standard was enjoined.
However, our fight will continue because aspects we deem unconstitutional and
inhumane go into effect at 12:01am on July 29th. The
section making it illegal for anyone to block traffic if they are soliciting
work or picking up day laborers will go into effect on the 29th. Activists will
be monitoring closely to make sure there aren't trumped up charges of
undocumented day laborers blocking traffic.
Also going into effect is the "grandma has to walk"
provision, making it illegal to knowingly or recklessly harbor or transport
undocumented immigrants. Civil disobedience and resistance will continue
until all human beings feel safe to go about their daily lives without fear of being "disappeared."
For the past two years law enforcement officers from the Maricopa County Sheriff's Office and several other municipal police departments have been stopping people of color for "improper lane changes," "improper right or left turns," or for no reason at all and turning them over to ICE. Unless and until the Department of Homeland Security instructs ICE not to accept non-criminal aliens, people of color in Arizona will continue to live in fear, and people of conscience will continue to fight to protect the human rights of all Arizonans.
